Golf Cart Pilot Project Application

Have you paid the permit application fee of $75 as required by the Municipality's User Fee by-law? If not, please make payment prior to completing this application. You may contact the Municipality by by calling 311 to make this payment.

A valid driver's licence is required in order to obtain a Golf Cart Permit. If you do not have one, you will not be able to proceed with the application. 

A photograph of the front and rear of the golf cart, must be provided. 

All applicants are required to provide, as part of this application, either a Certificate of Insurance, an official insurer letter, or another acceptable form of insurance documentation. This document must confirm that the applicant holds a valid insurance policy specifically covering the Golf Cart. The submitted documentation must be in a form satisfactory to the Municipality and meet the following requirements:

• Identification of the Golf Cart - The insurance documentation must clearly identify the Golf Cart covered under the insurance policy.
• Minimum Liability Coverage - The insurance policy must provide a minimum of $2,000,000.00 in general comprehensive liability coverage for bodily injury, death, and property damage. 
• Coverage for Municipal Road Use - The insurance documentation must explicitly state that the Golf Cart is insured for operation on municipal roads.
• Policy Validity - The insurance policy must be active and valid for the entire duration of the permit. 
• Licensed Insurer - The insurance policy must be underwritten by an insurer licensed to do so in the province of Ontario. 

If your Certificate of Insurance does not specifically state that the golf cart is insured for operation on municipal roads you must include a letter from your insurer stating the same. 

I, hereby acknowledge and agree that:

• the information provided in this application is true, accurate, and complete to the best of my knowledge;
• the Municipality of Chatham-Kent (the "Municipality") is bound by the Municipal Freedom of Information and Protection of Privacy Act, R.S.O. 1990, c. M.56 and that any information provided to the Municipality in connection with this application may be subject to disclosure in accordance with such legislation;
• the Golf Cart noted in this application has the features required by Section 7(1) of Ontario Regulation 407/21: Pilot Project - Golf Cars (the "Regulation") made under the Highway Traffic Act, R.S.O. 1190, c. H.8;
• if the Golf Cart is to be used any time from one-half hour before sunset to one-half hour after sunrise and at any other time when, due to insufficient light or unfavourable atmospheric conditions, persons and vehicles on the highway are not clearly discernible at a distance of 150 meters or less, that the Golf Cart has the features required by Section 8(1) of the Regulation;
• the Golf Cart noted in this application is deemed to be under my care and control, and I agree that the operators or drivers of this Golf Cart are subject to the same rules and regulations as other vehicles, including the requirement to hold a valid driver's license;
• as the owner of the Golf Cart noted in this application, I have made myself familiar with By-Law #100-2025 and the Regulation, which govern the use of Golf Carts on the highways within the urban area of Erieau in the Municipality, and I agree to abide by By-Law #100-2025 and the Regulation at all times in the operation of the Golf Cart noted in this application;
• if this application is approved by the Municipality, I will be required to indemnify and hold harmless the Municipality from any and all liability, loss, damage, expense, causes of action, lawyer's fees, suits, claims, and judgements, whether in law or equity, arising from any injury to any person or property resulting from or based on the actual or alleged use or operation of the aforementioned Golf Cart; 
• If this application is approved by the Municipality, I will have ongoing obligation to obtain and maintain in force, while registered as a Golf Cart, a policy of public liability insurance issued by an insurer licensed by the Province of Ontario, providing third-party liability coverage in an amount of not less than $2,000,000.00 for any damage or injury cause by the use of the Golf Cart, and an obligation to immediately notify the Municipality and surrender any permit issued pursuant to By-Law #100-2025 should the said policy of insurance expire, be cancelled, or be terminated for any reason; and
• I will pay the requisite application fee in full as required by the Municipality's User Fee By-Law.
